Are liability waivers enforceable in Australian Capital Territory?
The Australian Capital Territory did not adopt the broad recreational-activity waiver provisions seen in New South Wales, so a release for personal injury is read more narrowly here. The Civil Law (Wrongs) Act 2002 (ACT) governs, and providers rely largely on the recreational-services carve-out in section 139A of the Australian Consumer Law plus careful drafting.
Because the statutory room to exclude liability is limited, treat an ACT waiver as one layer alongside insurance and strong safety practices rather than a complete shield. A parent cannot sign away a child's claim, so use a minor's form as a consent record.
