Are liability waivers enforceable in Victoria?
Victoria is the cautious outlier. It did not adopt the broad recreational-activity waiver provisions seen in New South Wales, so a release is read narrowly. Under the Australian Consumer Law and Fair Trading Act 2012 (Vic), a term excluding the consumer guarantees for recreational services can be valid only if it uses the prescribed wording, and it never covers gross negligence.
Because the room to exclude liability is narrow, precise, service-specific language is essential in Victoria, and generic releases often fail. A parent cannot waive a child's claim, so use a minor's form as consent and assumption of risk, and rely on insurance and safety practice as the main protection.
