Are liability waivers enforceable in Alberta?
Alberta enforces clearly drafted liability waivers, and its Occupiers' Liability Act expressly lets an occupier restrict or exclude the usual duty of care by giving reasonable notice, for example a conspicuous sign together with a signed release. Genuine notice and plain language are what make an Alberta waiver hold up.
The release must be brought to the signer's attention before they sign, and it cannot cover gross negligence or intentional harm. As across Canada, a parent generally cannot waive a minor's claim, so use a minor's form as a consent and assumption-of-risk record and keep insurance in place.
