Are liability waivers enforceable in Manitoba?

Manitoba gave Canada one of its landmark waiver decisions: in Dyck v Manitoba Snowmobile Association the Supreme Court of Canada upheld a signed release that barred a negligence claim, confirming that a clear waiver, fairly presented, is binding. Manitoba courts continue to enforce conspicuous releases signed by adults.

The Occupiers' Liability Act of Manitoba also lets an occupier limit the ordinary duty of care with reasonable notice. A release still cannot excuse gross negligence, and a parent cannot waive a minor's claim, so pair a minor's consent form with good safety practices and insurance.
