Are liability waivers enforceable in Nova Scotia?
Nova Scotia enforces a clearly written release of liability for ordinary negligence where the business took reasonable steps to bring it to the signer's attention. It also has an Occupiers' Liability Act that lets an occupier restrict the duty of care with adequate notice, which strengthens a well-presented waiver.
