Are liability waivers enforceable in Nunavut?

Nunavut follows Canadian common-law principles and generally gives effect to a clearly written, conspicuous release signed by an adult. Case law from the territory is very limited, so a business should not assume a form will be read generously; clear wording and genuine notice are essential.

A release cannot excuse gross negligence, and a parent cannot waive a minor's claim. Because local precedent is scarce, careful activity-specific drafting matters, and insurance and safety practices should carry the main load.
